These Customer Policies & Terms of Sale (the “Terms”) apply to all purchases from Sweetinity, including pre-designed products ordered through our online shop (“Pre-Designed Orders”) and cakes or desserts ordered through a custom inquiry, quote, invoice, telephone call, email, social media, or other communication (“Custom Orders”). By submitting payment, the customer (“Customer” or “you”) confirms that you have reviewed, understood, and agreed to these Terms.
1. ORDER ACCEPTANCE AND FULL PAYMENT
All orders require payment in full in advance. An inquiry, consultation, proposal, quote, draft invoice, or discussion does not reserve a date or create an obligation for Sweetinity to perform. An order is accepted, and the requested date is reserved, only when:

Sweetinity has confirmed availability;

Sweetinity has issued or approved the final order details and total price;

Sweetinity has received cleared payment in full; and
-
the Customer has accepted these Terms through checkout, invoice payment, written acknowledgment, or another electronic method.
Orders are accepted subject to ingredient, equipment, staffing, and scheduling availability. Sweetinity may decline an inquiry before payment is accepted.
The person submitting payment is the contracting Customer and is responsible for the accuracy of all order information, communicating these Terms to the recipient or event host, and ensuring that pickup, delivery, storage, display, and service instructions are followed.
2. PRICING, TAXES, AND ADDITIONAL CHARGES
Prices shown online for Pre-Designed Orders apply only to the stated size, flavor, design, quantity, and fulfillment method. Custom Order pricing is based on serving size, ingredients, design complexity, labor, supplies, delivery, setup, timing, and other order-specific requirements.
Unless expressly included in writing, prices do not include delivery, setup, stand or equipment rental, venue fees, parking, tolls, rush charges, special packaging, fresh flowers, toppers, or other third-party items. Applicable taxes and disclosed fees will be added as required. Any approved addition or change may require additional payment before work continues.
Sweetinity is not responsible for typographical or obvious pricing errors. If an error is discovered before production, Sweetinity will notify the Customer and allow the Customer to pay the corrected price or receive a refund of the amount paid for the affected item.
3. FINAL SALE; NO REFUNDS FOR CUSTOMER CANCELLATIONS
ALL SALES ARE FINAL. ALL PAYMENTS ARE NONREFUNDABLE AND NONTRANSFERABLE. Because Sweetinity reserves production capacity, declines other work, plans designs, purchases ingredients or supplies, and performs administrative and preparatory work specifically for each paid order, no refund, store credit, exchange, transfer, or rescheduling is provided when the Customer:

cancels an order or event for any reason;

changes their mind;
-
no longer needs or wants the order;
-
provides incorrect order, event, pickup, delivery, or contact information;
-
fails to obtain venue approval or required access;
-
fails to pick up or accept delivery;
-
experiences a change in guest count, event plans, weather, travel, illness, finances, or personal circumstances; or
-
is dissatisfied with a matter that was disclosed, approved, subjective, or within the permitted variation described in these Terms.
Food and custom-made products cannot be returned or exchanged after pickup or delivery.
This no-refund policy does not eliminate any nonwaivable rights available under applicable law. If Sweetinity cancels an accepted order and does not provide the purchased goods, Sweetinity will refund the amount paid for the unprovided goods. If Sweetinity delivers a product that is materially different from the written order confirmation due to Sweetinity’s error, any remedy will be determined under Section 14 and applicable law.
4. RESCHEDULING
Sweetinity is not required to reschedule an order. A Customer may request a new date in writing, but approval is entirely subject to Sweetinity’s availability, production status, ingredient and supply commitments, and receipt of any rescheduling or price-difference charge specified by Sweetinity.
Unless Sweetinity confirms a rescheduling exception in writing, the original order remains due for pickup or delivery on the original date and all payments remain nonrefundable. Approval of one exception does not modify these Terms for any other order.
5. PRE-DESIGNED ONLINE ORDERS
Pre-Designed Orders include only the options displayed and selected at checkout. Product photographs are examples. Handmade products naturally vary, and minor differences in color, shape, finish, placement, piping, fruit, flowers, décor, and proportions are not defects.
Requests entered in an order note are not guaranteed and do not amend the order unless Sweetinity expressly approves them in writing. Sweetinity may substitute a substantially similar decorative element, ingredient brand, fruit, flower, packaging component, or finishing detail when the original is unavailable, provided the substitution does not materially alter the essential product or conflict with a disclosed allergy.
6. CUSTOM ORDERS, DESIGN APPROVAL, AND ARTISTIC DISCRETION
The written order confirmation, paid invoice, and any Sweetinity-approved specifications together form the final Custom Order. The Customer must review all names, dates, ages, spelling, flavors, colors, servings, design elements, pickup or delivery details, and allergen disclosures before paying.
Inspiration images are references only. Sweetinity will not guarantee an exact copy of another artist’s work or of a prior cake. The Customer authorizes Sweetinity to use reasonable artistic judgment and creative discretion. Colors may vary because of lighting, screens, photography, ingredient behavior, food coloring, temperature, and the handmade process. Certain dark or highly saturated colors may temporarily stain the mouth or affect flavor.
Serving estimates are approximate and depend on how the product is cut. Sweetinity does not guarantee a specific number of servings unless slice dimensions and service method are expressly agreed upon in writing.
The Customer represents that they have permission to request any name, photograph, logo, character, trademark, artwork, or other material supplied to Sweetinity. Sweetinity may refuse any requested element that it believes may be unsafe, unlawful, infringing, discriminatory, or inconsistent with its standards.
7. CHANGES TO AN ACCEPTED ORDER
All change requests must be submitted in writing. No change is effective unless Sweetinity confirms it in writing. Sweetinity may deny changes after payment, particularly after design, ordering, preparation, or production has begun.
Approved changes may require additional payment and may affect design, size, ingredients, completion time, or delivery. Reducing the size, quantity, complexity, or scope does not create a refund or credit. If a requested change cannot be accommodated, the original accepted order remains in effect.
8. RUSH ORDERS
Orders accepted with limited lead time may require a rush fee and may have restricted design, flavor, size, or delivery options. Rush fees compensate for expedited scheduling and are nonrefundable. Sweetinity does not guarantee acceptance of any rush request until full payment is received and the order is confirmed.
9. PICKUP
The Customer or designated pickup person must arrive at the confirmed location and time. The order will be deemed accepted once it is inspected and taken from Sweetinity’s possession. The pickup person is authorized to inspect and accept the order on the Customer’s behalf.
The Customer is responsible for providing a clean, level, unobstructed cargo area; maintaining a cool vehicle; driving carefully; and following all handling instructions. Cakes should not be placed on a seat, lap, or other sloped or unstable surface. Sweetinity is not responsible for damage, melting, shifting, contamination, or deterioration occurring after pickup, except to the extent caused by a nonwaivable legal violation by Sweetinity.
Late pickup does not extend product freshness or create a refund. If the Customer fails to pick up during the agreed window and has not made another written arrangement accepted by Sweetinity, the order may be treated as abandoned and may be discarded without refund.
10. DELIVERY AND SETUP
Delivery is available only when confirmed in writing and is subject to location, access, traffic, weather, parking, venue rules, and schedule. A quoted delivery time is a reasonable estimate unless Sweetinity expressly guarantees a specific time in writing. The Customer must provide complete access instructions and ensure that an authorized adult is available to receive and inspect the order.
If delivery or setup is delayed or prevented by inaccurate information, unavailable recipients, locked gates, unsafe conditions, venue restrictions, lack of parking, stairs or access not disclosed in advance, or other circumstances outside Sweetinity’s reasonable control, Sweetinity may leave the order with an authorized person or at a reasonably safe agreed location, return it for later pickup, or charge additional waiting, redelivery, parking, toll, or setup fees. These circumstances do not create a refund.
Responsibility for the product transfers to the Customer when the product is delivered to the Customer, recipient, venue, planner, caterer, or other authorized person, or when setup is completed. Sweetinity is not responsible for later movement, handling, cutting, display conditions, outdoor exposure, insects, heat, sunlight, wind, humidity, unstable tables, refrigeration failure, venue staff, guests, pets, or third parties.
11. CAKE CARE, STORAGE, DISPLAY, AND FOOD QUALITY
The Customer must follow all written or verbal care instructions. Unless product-specific instructions state otherwise:

refrigerate products promptly and maintain a safe temperature;
-
transport cakes on a flat, stable surface in a cool, air-conditioned vehicle;
-
keep products away from direct sunlight, heaters, moisture, and excessive heat;
-
do not leave perishable products in a parked vehicle;
-
use a stable table suitable for the product’s weight;
-
remove all non-edible supports, wires, picks, toppers, ribbons, flowers, and decorations before serving; and
-
consume the product within the recommended period.
Fresh flowers and other non-edible decorative materials are not food and may contain pesticides, sap, pollen, wire, floral tape, picks, or other components. The Customer is responsible for notifying guests and removing non-edible materials before service.
Once the product leaves Sweetinity’s custody, Sweetinity cannot control storage, transportation, display, or service and cannot guarantee condition or food quality when care instructions are not followed.
12. ALLERGEN AND DIETARY NOTICE
Sweetinity products are prepared in a shared kitchen where common allergens are present and handled, including milk, eggs, wheat, soy, peanuts, tree nuts, and sesame, and may include or come into contact with other allergens. Sweetinity cannot guarantee that any product, surface, utensil, equipment, ingredient, or preparation area is allergen-free or free from cross-contact.
The Customer must disclose all allergies and dietary restrictions in writing before payment and must review ingredient and allergen information provided for the specific product. A dietary preference or recipe modification does not mean that a product is medically safe for an allergy. Sweetinity may decline an order when it cannot reasonably accommodate a request.
For a severe or life-threatening allergy, Sweetinity strongly recommends that the affected person not consume its products. The Customer is responsible for communicating accurate allergen information and this warning to every recipient and guest. Sweetinity does not waive responsibility for accurate disclosures required by law or for conduct that cannot legally be released.
13. INGREDIENTS, LABELING, AND SUBSTITUTIONS
Ingredients may vary by product and supplier. The Customer must request current ingredient information when needed and must not rely only on a photograph, product name, prior purchase, or informal message. Sweetinity will provide legally required labeling or allergen disclosures applicable to its products and business classification.
Reasonable ingredient or décor substitutions may be made because of seasonality, shortages, quality, or supplier availability. Sweetinity will not knowingly substitute an ingredient that conflicts with an allergy disclosed and accepted in writing. A material substitution will be communicated when reasonably practicable.
14. INSPECTION, PROBLEMS, AND LIMITED REMEDIES
The Customer or authorized recipient must inspect the order when it is picked up or personally delivered. Any visible damage, incorrect wording, missing item, or material difference from the confirmed order must be reported to Sweetinity before the product is accepted, transported, moved, altered, displayed, served, consumed, or released to another person.
Once the Customer or authorized recipient accepts the order, its appearance and visible condition are considered approved. Responsibility for proper transportation, handling, refrigeration, storage, display, and service transfers to the Customer at that time. Sweetinity is not responsible for damage or deterioration occurring after acceptance due to improper handling, movement, heat, sunlight, refrigeration failure, an unstable display surface, venue conditions, guests, event staff, or another third party.
A concern that could not reasonably have been discovered during inspection must be reported to Sweetinity in writing within 24 hours after pickup or delivery. The Customer must provide the order number, a description of the concern, and clear photographs showing the product and the reported issue. The remaining product must be properly stored and made reasonably available for review. Failure to provide sufficient information or preserve the product may prevent Sweetinity from verifying the concern.
All sales remain final. Customer preference, subjective differences in taste or appearance, minor variations inherent in handcrafted products, approved design elements, natural color variations, incorrect information supplied by the Customer, or damage occurring after acceptance do not qualify for a refund, credit, replacement, or remake.
If Sweetinity verifies that it made a material error, Sweetinity will determine an appropriate remedy based on the circumstances, which may include correcting the product when reasonably possible, replacing the affected portion, providing a credit, or providing another remedy required by applicable law. Nothing in this policy limits any right or remedy that cannot legally be waived.
15. PHOTOGRAPHS AND MARKETING
Unless the Customer opts out in writing before the event date, Sweetinity may photograph the product and use images of the product for its portfolio, website, social media, advertising, and promotional materials. Sweetinity will not intentionally identify the Customer, disclose private event information, or use recognizable images of people supplied by the Customer without additional permission.
The Customer may share photographs of the product for personal use. Sweetinity retains ownership of its original designs, sketches, photographs, written content, and branding, subject to any third-party rights.
16. RENTAL ITEMS AND SECURITY CHARGES
Cake stands, display pieces, boards identified as reusable, props, separators, and other rental items remain Sweetinity’s property. Rental terms, deposits or security authorizations, return deadlines, and replacement charges will be stated in the order. The Customer is responsible for loss, theft, breakage, damage, or late return while rental items are in the Customer’s or venue’s custody. A refundable security amount, if any, is separate from the nonrefundable food-order payment.
17. CUSTOMER-PROVIDED AND THIRD-PARTY ITEMS
Sweetinity is not responsible for the quality, safety, legality, compatibility, condition, or performance of items supplied by the Customer or a third party, including toppers, flowers, charms, photographs, alcohol, stands, candles, or decorations. Sweetinity may refuse to place or use an item it considers unsafe or unsuitable. The Customer assumes responsibility for obtaining any permissions and for providing items by the agreed deadline.
18. EVENTS BEYOND REASONABLE CONTROL
Sweetinity is not liable for delay or inability to perform caused by events beyond its reasonable control, including severe weather, wildfire, evacuation, utility failure, road closure, government order, supply interruption, accident, sudden illness, public emergency, or venue closure. Sweetinity will notify the Customer as reasonably practicable and may offer an available substitute, reasonable postponement, or refund for goods Sweetinity ultimately cannot provide. This section does not excuse obligations that cannot legally be waived.
19. COMMUNICATIONS AND ELECTRONIC AGREEMENT
The Customer consents to receiving order-related communications electronically at the email address or telephone number provided. Electronic acceptance, checking an acceptance box, clicking a payment button after the Terms are displayed or linked, or paying an invoice that conspicuously states acceptance constitutes the Customer’s electronic agreement to these Terms to the extent permitted by law.
The Customer must promptly notify Sweetinity of incorrect contact information. Sweetinity is not responsible for missed communications resulting from inaccurate information, spam filtering, a full mailbox, or failure to review messages.
20. PAYMENT DISPUTES AND CHARGEBACKS
Before initiating a payment dispute or chargeback, the Customer agrees to contact Sweetinity promptly and provide a reasonable opportunity to review and address the concern. A chargeback does not cancel these Terms or determine the legal merits of a dispute. Sweetinity may provide the payment processor with the accepted Terms, invoice, communications, photographs, fulfillment records, and other relevant evidence.
Sweetinity will not impose a penalty merely for exercising a lawful billing-dispute right. However, the Customer remains responsible for amounts validly due under these Terms and for remedies allowed by law if a dispute is knowingly false or fraudulent.
21. PRIVACY
Sweetinity may collect contact, order, event, payment-status, delivery, dietary, and communication information as reasonably necessary to quote, accept, prepare, fulfill, document, and support orders. Payment card information may be processed by third-party payment providers under their own privacy and security terms. Sweetinity does not sell payment card information.
Any separate Privacy Policy posted by Sweetinity is incorporated into these Terms. If California privacy statutes apply to Sweetinity based on its activities and legal thresholds, Sweetinity will provide the notices and rights required by those laws.
22. GOVERNING LAW, VENUE, AND SEVERABILITY
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. To the extent permitted by law, any court proceeding concerning an order must be brought in a court of competent jurisdiction in Riverside County, California. Nothing in this section prevents a party from using a legally available California small-claims court or any forum that cannot lawfully be restricted.
If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted or severed, and the remaining provisions will remain in effect. Sweetinity’s failure to enforce a provision once is not a waiver of future enforcement.
23. ENTIRE AGREEMENT; ORDER OF PRECEDENCE
These Terms, the final written order confirmation, and the paid invoice constitute the complete agreement for the order and replace prior discussions about the same subject. Any amendment must be confirmed in writing by Sweetinity. If an order-specific written term conflicts with these general Terms, the order-specific term controls only for that order.
